Judge Bennett presided over his fifth jury trial, sitting for Judge Susan Kelly, in the 54th District Court in the case of State v. Joe Herrera. The jury convicted Herrera of one count of assault family violence by occlusion and one count of assault family violence with a prior family violence conviction. Because Herrera was an habitual offender, the jury assessed his punishment at 40 years for both charges.
